EU Flouts Its Own Law on Use of Cookies

The European Council website, which is a sub domain of the main EU website, is running Google Analytics to capture the usage statistics of the website. There is no “opt-in” option on the website as required by EU legislation. This legislation refers to Directive 2009/136/EC which amended the European Directive – 2002/58/EC – which is concerned with the protection of privacy in the electronic communications sector. Governments in Europe had until 25 May 2011 to implement these changes into their own law. The UK introduced the amendments on 25 May 2011 through The Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011.

The code below is directly from the source of the European Council website and clearly shows the Google Analytic’s javascript.

The “Legal Notice” page of the site has the following statement regarding the use of Google Analytics:

The last paragraph is interesting. It highlights the Google Analytics Opt-out Browser Add-on, which perhaps the EU is saying, despite the guidance given by the Information Commissioner’s Office (ICO) in the UK, an opt-out is enough to comply with the legislation or they’ve so far been lapse and not updated their website accordingly.

According to the ICO the law requires that all websites run by companies in the EU have to obtain permission from the visitor of the site before their usage can be monitored using cookies. Google Analytics and other statistics solutions use cookies to follow the visitor as they move from page to page, allowing the website owner to quickly analyse how their website is used. It’s an incredibly useful tool and the EU legislation has caused up-roar with businesses that use these tools to help improve their websites for the benefit of their customers.

Google and other web analytics vendors are in conversation with the EU regarding this law, but in the meantime, perhaps the EU should get it’s house in order before it starts pursuing companies who are trying to deliver the best service to the customers and rely on this information to do so. After all, this puts companies in the EU at a potential disadvantage when compared to those in countries not under this legislation.

Maybe the EU should be taken to court for non-compliance with their own law unless, as mentioned above, using the Google Analytics opt-out is enough?

Rotherbank Residential Care Home is a family operated care home based in Liss, Hampshire. Sarah Parker Interiors, established in 2002 is a design inspired property development and renovation company that has grown into an interior design consultancy. The Sarah Parker website was to be a static site based off of a rough design already completed by the client. They wanted a modern and simple look to the site that makes use of big, high resolution images for added visual impact. The site was developed using HTML, CSS (including CSS3 aspects) and Javascript in the form of jQuery Lightbox for use in the portoflio galleries.

Sprintspeed are leading manufacturers of Triumph Dolomite parts and components and wanted a website where they could not only tell people what they do, but where they could keep their customers up to date with the latest news and events occurring in the world of motorsport, something which they are heavily involved in. Their existing website had been built using the Joomla system. They wanted their new one to use the a similar design, but be based off of the WordPress system which would make it much easier to update and maintain. We adapted their design to WordPress, which involved completely re-building the website using only visual references, and gave them the capability to have a news feed which they could update and galleries to neatly and easily publish their albums of photos to the website.

Wenman Demolition is an independent demolition firm based in Beech, Hampshire. They came to us wanting a new website to help promote their business and establish a better online presence within a certain budget. Evolution AV is a company based in Hampshire offering custom audio-visual design and installation. We were approached to provide SEO services for their existing website in an attempt to help it gain better search engine rankings as it was previously no appearing for many of their selected keywords. We performed an SEO website health check in order to evaluate their content and make changes that would benefit the organic ranking of their pages. This included re-ordering content, checking the heading tags were correct and ensuring content was relevant amongst other things.

This month’s SEO work was, as always carried out on K3 Business Solutions, Southern Trailers and Cassidy Coutts Donald with the aim being to continue to check the performance of their current keywords and in search engines (such as Google’s) organic results. For K3 Business Solutions the focus was on adding relevant pages for the keywords “Channel Distribution Software“, “Distribution Business Software” and “Distribution Software“. These new pages should help K3 Business Solutions appear higher in the search engine rankings when these terms are searched.

For Southern Trailers the focus is very much on boosting what already exists. By running a monthly ranking report we are able to see how they rank for terms such as Brian James Trailers and Car Trailer Hire and from that do what we can to those pages to make them more search engine friendly.

Cassidy Coutts Donald’s search engine optimisation campaign has been very successful. With nearly all of their selected keywords appearing on the first page of Google’s search results our aim here is to maintain these rankings whilst making small changes to pages such as Independent Financial Advisors Hampshire and Independent Financial Advisors Surrey to help push their keywords higher up the rankings and achieve more number one spots.
