Futuresys Ltd provides World Wide Web page hosting and design and search engine optimisation services. Futuresys Ltd reserves the right to suspend or cancel a customer’s access to any or all services provided by Futuresys Ltd should Futuresys Ltd decide in its reasonable opinion that the account has been inappropriately used.
Web hosting accounts are to be used by the primary owner only.
Web hosting account holders are not permitted to resell, store or give away web-hosting services of their website to other parties.
Web hosting services are defined as allowing a separate, third party to host content on the owner’s web site. Exceptions to this include ad banners, classified ads, and personal ads.
Futuresys Ltd reserves the right to refuse service and / or access to its servers to anyone.
Futuresys Ltd do not allow any of the following content to be stored on its servers:
Futuresys Ltd reserves the right to determine in its sole discretion what constitutes unsolicited commercial bulk email (“UCE”) based on the information available but shall include, inter alia, news postings or chain letters; advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE; use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by Futuresys Ltd. maintaining an Open Email Relay allowing email to be sent through a customer’s system by a third party (i.e. neither to nor from Customer or Customer’s accounts).
Resources are defined as bandwidth and/or processor utilization.
When a website is found to be monopolizing the Resources available Futuresys Ltd reserves the right to suspend that site immediately.
This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Futuresys Ltd continues hosting the website for an additional fee.
All accounts are set up on a prepay basis and no service will be provided until payment has been made and cleared.
Although Futuresys Ltd reserves the right upon the giving of notice to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment.
Payment is due in advance of the agreed dates. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been received.
Futuresys Ltd reserves the right to suspend all services until an outstanding debt is cleared.
Futuresys Ltd reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of advanced payment unless cancellation is due to breach by the customer of Futuresys Ltd’s terms of service in which case a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time by written notice to Futuresys Ltd but such cancellation shall only be effective upon actual receipt by Futuresys Ltd of such notice.
During the initial 30 day period for any service related invoice customers who wish to cancel will be entitled to a full refund for their hosting fees for that service to the total value of the related invoice. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Once the initial 30 day period from first invoice date has expired customers are not entitled to receive a refund unless the service is cancelled by Futuresys Ltd.
In addition some accounts incur set-up fees, these charges are also non-refundable.
Customer may cancel purchase order for web design but will be liable for all costs incurred up to the date of receipt of cancellation
Futuresys Ltd reserves the right to cancel the service at any time. All quotations given by Futuresys Ltd are guaranteed for no more than 30 days. After 30 days the quotation should be considered null and a new quote requested.
Customer agrees that it shall defend, indemnify, save and hold Futuresys Ltd harmless from any and all demands, liabilities, losses, costs and claims, including all attorney’s or legal fees asserted against Futuresys Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed for or to the order of the customer or agreed to be so provided or performed or any product sold by customer, its agents, employees or assigns through the medium of the customer’s website.
Customer agrees in so far as permissible by law to defend, indemnify and hold harmless Futuresys Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed through the medium of a Futuresys Ltd server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary or intellectual property rights of a third party; (3) copyright infringement and (4) any defective products sold to customer through the medium of a Futuresys Ltd server.
Futuresys Ltd will not be responsible for any damage or loss you or your business may suffer as a result of failure of service by Futuresys Ltd howsoever such damage or loss may arise.
Futuresys Ltd makes no warranties of any kind, expressed or implied for services we provide.
Futuresys Ltd disclaims any warranty as to merchantability or fitness for any particular purpose of the services it provides. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions whether caused by Futuresys Ltd and its employees or otherwise.
Futuresys Ltd reserves the right to revise its policies at any time.
During the term of its agreement with Futuresys Ltd, Customer must ensure that the use by Customer of any resource offered to Customer by Futuresys Ltd or owned or controlled by Futuresys Ltd ("Service") conforms with Futuresys Ltd’s then current Acceptable Use Policy ("AUP"). Futuresys Ltd may modify, without prior notice, the AUP as Futuresys Ltd deems appropriate; such modified AUP is effective and shall bind Customer upon posting of notice of such change on Futuresys Ltd’s website.
The Service must not be used to publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: threatening, harassing, defamatory, obscene, or fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute.
The Service must not be used to request unlawful services or materials.
The Service must not be used for activities Futuresys Ltd deems to impact its customers or its ability to deliver services to its customers.
The Service must not be used for any purpose involving
Using a false identity; using pyramid/ponzi scheme; storage or transmission of any intentionally incorrect data or packet.
The deliberate transmission of computer viruses, worms or trojan software.
Using any technique to intentionally degrade or disable the delivery of any legitimate data.
Attempting to gain unauthorized entry to any site or network, or any network or host scanning, probing, monitoring or other information gathering associated with such activity; using the Service to guess passwords.
Inappropriate postings to newsgroups, chat rooms, electronic bulletin boards and any other public forum on, or using, the Service.
Customers sending bulk email must provide recipients with an easy and effective mechanism for removal from the bulk email list. Customer must include the source of the addressee’s address in each bulk email message.
Customer agrees not to resell the Service or any portion of the Service unless expressly authorized to do so by Futuresys Ltd.
Customer is responsible for protecting passwords and for any authorized or unauthorized use.
Customer agrees to provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material that Customer publishes via any Service.
Customer is responsible for all content or information residing on, or obtained or transmitted via, the Service, regardless of whether such use is by Customer or some other person permitted or enabled by the Customer.
Customer activity that facilitates the violation of this AUP by any party constitutes a violation of this AUP by Customer.
Violation of the AUP may subject Customer to international, federal, and/or state civil and/or criminal liability. Futuresys Ltd reserves the right in its sole discretion and without prior notice to suspend and/or terminate Customer’s access to the Service at any time for violating this AUP.
Futuresys Ltd also reserves the right to suspend, filter or block, and/or terminate Customer’s access if Customer’s account is being used to or reasonably believed to being used to exploit or attack the Service or the networks of others.
If Customer’s account has been compromised and attempts to reach Customer and/or to have Customer repair a breach of security fail, Futuresys Ltd reserves the right to suspend or terminate Customer’s service.
If Customer’s access is suspended or terminated, Futuresys Ltd, in its sole discretion, may refuse to accept all new e-mail sent to the terminated e-mail address and delete Customer’s data stored on Service.
Futuresys Ltd will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.
These terms and conditions are governed and construed in accordance with the Laws of England.
